In early 2010, the U.S. Department of Justice (“DOJ”), European Commission (“EC”) and the Japan Fair Trade Commission (“JFTC”) initiated investigations into cartel conduct in the automobile parts industry. Thereafter, the enforcement agencies discovered that companies had, among other violations, fixed prices and rigged bids from early 2000 to 2012 in the industry for various products.  The DOJ has found violations in  products including automotive wire harnesses, instrument panel clusters, fuel senders, electronic control units, heater control panels, speed sensor wire assemblies, seatbelts, airbags, steering wheels, ignition coils, switches, steering angle sensors, high intensity discharge ballasts, lighting fixtures, starter motors, alternators, air flow meters, valve timing control devices, fuel injection systems, electronic throttle bodies, inverters, motor generators, windshield washers and wipers, compressors, condensers, automatic transmission fluid warmers, air conditioning systems, bearings, electric powered steering assemblies, anti-vibration rubber products, spark plugs, standard oxygen sensors, air fuel ratio sensors and hoses, parking heater and manual steering column. The DOJ has imposed monetary fines and prison terms on companies and individuals. The EC has found violations in products including automotive wire harnesses, flexible foam used in car seats, bearings, fuel-operated parking heaters and has imposed fines. The JFTC has issued cease and desist orders and surcharge payments against several companies relating to products such as automotive wire harnesses, generators, starters, windshield wiper systems, radiators, electrical fans, headlamps, rear combination lamps and bearings. These enforcement agencies’ investigation is ongoing.

 

In Canada, at least seven companies have pleaded guilty for their participation in the cartel with fines totaling 56.2 million (CAD).

In Australia, at least two companies have been ordered by consent to pay penalties to totaling 5 million (AUD) for their participation in the cartel.

In Korea, at least seven companies have been imposed fines of over ₩122 billion in total for their participation in the cartel.

In China, ten companies have been imposed fines of RMB1.24 billion in total for their participation in the cartel while two other companies received immunity.
 
Enforcement Highlights:

  • The DOJ imposed fines totaling more than $2.4 billion on more than thirty companies and prison terms on numerous executives for their participation in the cartel.
  • The JFTC imposed fines on several companies exceeding a total of ¥34 billion.
  • The EC imposed fines totaling more than €1.1 billion.
  • The Canadian Competition Bureauimposed fines totaling 56.2 million(CAD).
  • The Australian Competition and Consumer Commission imposed fines to totaling 5 million (AUD).
  • The Korea  Fair Trade Commission imposed fines totaling over ₩ 122 billion.
  • The Chinese National Development and Reform Commission (NDRC) imposed fines totaling RMB1.24 billion.
